The Consequences of Failing to Stop at a Stop Sign or Red Light in Ontario

Stop Sign tickets are one of the most common offences that we deal with on a daily basis.
Our experience indicates that individuals, who receive a ticket for disobeying a Stop Sign or failing to stop, honestly believe that they came to a stop. The questions to know is: What is considered a stop?
Disobey Stop Sign – Fail to Stop
Section 136 (1) of the Highway Traffic Act of Ontario reads as follows;
Every driver or street car operator approaching a stop sign at an intersection,
(a) shall stop his or her vehicle or street car at a marked stop line or, if none, then immediately before entering the nearest crosswalk or, if none, then immediately before entering the intersection; and
(b) shall yield the right of way to traffic in the intersection or approaching the intersection on another highway so closely that to proceed would constitute an immediate hazard and, having so yielded the right of way, may proceed. R.S.O. 1990, c. H.8, s. 136 (1).

Section 144(18) of the Highway Traffic Act of Ontario reads as follow;
Every driver approaching a traffic control signal showing a circular red indication and facing the indication shall stop his or her vehicle and shall not proceed until a green indication is shown. R.S.O. 1990, c. H.8, s. 144 (18).
